you a limited Warranty to protect your investment
to help you enjoy your new mattress.
Your Limited Warranty starts as soon as your product is delivered.
Please read carefully the following information related to the terms and conditions of the Limited Warranty of your new products. 
Your new mattress is covered with a Limited Warranty, which is not transferable. It is valid only for the original mattress purchaser from the
HIBERIS™ website or an authorized retailer. 
All purchases made from Amazon or other Marketplace may be subject to different or additional terms and conditions.
The product must be purchased for personal use only,
not with the intent to resell it. 
This Limited Warranty will be terminated if the original purchaser sells or assigns ownership of the mattress to another.

 

Because we cannot handle international shipping and logistics expenses, the HIBERIS™ Limited Warranty applies only to HIBERIS™ products sold in the United States of America.

Only ONE (1) mattress returned per customer, household, and home address is acceptable, and returns are only valid on your first-time purchase. 

If a mattress is returned, that customer and shipping address will not be eligible for additional 100-night trials for a minimum of one (1) year. 

Mattress delivery, removal, and other shipping costs are not refundable.

This Limited Warranty is non-transferable. Your new HIBERIS™ mattress is warranted against manufacturing defects, faulty workmanship, and material defects. This Limited Warranty runs from the original date of delivery of your mattress. This limited warranty is valid only with the original purchaser of the product listed on the original invoice or purchase receipt to use the product for personal consumer use, not with the intent to resell the product. 

You must be the original purchaser from HIBERIS SLEEP Corp. or an authorized dealer, and your name must appear on the invoice or purchase receipt. 

All purchases made in our authorized Retailers may be subject to different or additional terms and conditions.

Throughout this LIMITED WARRANTY,

  • The terms “we,” “us,” and “our” shall refer to HIBERIS. 
  • The term “HIBERIS,” “HIBERIS Products,” or “HIBERIS Mattress” shall refer to HIBERIS CORP.
  • The terms “you,” “your,” “its,” and “their” shall refer to the original purchaser/buyer/customer.

Your new mattress is covered with a limited warranty that is not transferable.

Since HIBERIS™ mattresses offer a range of health benefits, HIBERIS products are not sold as medical devices or substitutes for any instructions, prescriptions, or directions prescribed by a licensed physician. Please consult your doctor or a licensed physician if you have any questions or concerns about your health condition and need medical treatment.

HIBERIS™ makes no medical claims regarding its products for allergies, discomfort, or other health conditions. Also, HIBERIS™ makes no promises of health regarding its products to treat or cure diseases. The effectiveness varies from person to person, and each person is unique, and their medical needs differ from one to another, even people with the same physical condition.

IMPORTANT INFORMATION 

The use of cleaning products not recommended by HIBERIS™; may damage the fabric and materials in your mattress. In addition, allowing water or other liquids to penetrate your mattress may damage the layers of your mattress, causing materials to compress. 

Either of these situations may result in damage that may invalidate your Limited Warranty.

BREAK-IN ADJUSTMENT PERIOD

The old mattress you’ve been sleeping on for years has adjusted to your body curve, size, and sleeping positions. So, the breaking period in your new mattress may take a few days, weeks, or over a month, which may vary from person to person. The new mattress you just parched will require time and patience to adjust to your body. It may not feel entirely comfortable until the materials have stretched and softened. 

The materials used to make your new mattress are flexible but strong and sometimes rigid; think of it as buying a new pair of shoes. They might feel uncomfortable initially because the materials have yet to become flexible and moldable with repeated use. 

The same principle applies to a bed. A new mattress may only feel comfortable once the materials have stretched and softened. So, we encourage you to sleep on your new HIBERIS™ mattress for a minimum of 30 nights to allow your body for the adjustment period. Although this adjustment period may seem inconvenient when you want to enjoy sleeping on your new mattress immediately, you should not judge your new mattress by just a few nights of sleep. While some users may not feel the difference, this adjustment period on a new mattress could be inconvenient, but it is entirely normal. 

It is common for some users to take weeks or over a month before feeling entirely comfortable on their new bed. 

These new mattresses have an elastic feel and still provide excellent back support. 


ROTATING YOUR MATTRESS

ROTATING YOUR MATTRESS IS IMPORTANT FOR YOUR COMFORT AND HELPS EXTEND THE LIFE OF YOUR NEW HIBERIS™ MATTRESS.

Your mattress is designed to conform to your body’s contours within the first few weeks. 

So if you notice impressions, don’t worry; the system is functioning correctly. 

To prevent excess body impressions, you must rotate your mattress: 

Rotate your new mattress after/on the first month of use (30 days). 

  • After/on the third month of use, rotate your new mattress again.
  • Repeat this cycle every three months.

Failure to do so may invalidate your mattress's Limited Warranty.

TRANSPORTATION AND SHIPMENT

All our mattresses are handmade and distributed out of our warehouse in Florida.

It is essential that you thoroughly inspect the product before use.

Return Policy

“NO REFUNDS OR RETURNS WILL BE GRANTED AFTER 100 DAYS”.

This Limited Mattress Warranty is valid only with the original purchaser of the product listed on the original invoice and/or purchase receipt with the intent to use the product for personal consumer use, not with the intent to resell the product.

HIBERIS™ SLEEP CORP. is unable to warranty or exchange a mattress or any accessories if there is evidence of damage, physical abuse, or neglect, including but not limited to: improper environmental conditions, blood or bodily fluid, or other fluids, stains, soiling, folds, unsanitary conditions, torn, footprints, spotted, splotchy, smudgy, foxy, fluid penetration, scratch, tears, burns, cuts, rodents, insect damage or other infestation, smoke aroma, odor, signs of jumping on the bed, damage from weather or sun exposure or dirt of unknown origin or nature. Any of the situations above may result in damage that will invalidate your warranty.

PLEASE BE ADVISED: THAT YOUR NEW MATTRESS IS NOT FIRE-PROOF.

Your new mattress meets fire safety standards issued by the U.S. Consumer Product Safety Commission. In addition, compared to older mattresses, your new mattress will, if ignited, burn more slowly and less intensely, giving you more time to escape from the room you were sleeping-in. 


TO REDUCE THE RISK OF FIRE: 

  • Don’t smoke in bed. It is a common cause of fatal fires. 
  • Do keep matches and lighters away from children. 
  • Don’t use candles on or around your bed. 
  • Do keep space heaters away from your bed or other flammable items. 
  • Don’t run electrical cords under your mattress or trap them against a wall. 
  • Don’t place lamps where they can fall on the bed. 

IN CASE OF FIRE, EXIT, AND THEN CALL 911

This Limited Warranty is non-transferable. 

This Limited Warranty runs from the original date of delivery of your mattress.

PLEASE READ CAREFULLY THE TERMS OF THIS LIMITED WARRANTY SO YOU ARE AWARE OF THE TERMS AND CONDITIONS OF THE LIMITED WARRANTY FOR YOUR PRODUCTS AND CAN TAKE ALL NECESSARY PRECAUTIONS IN CASE A REPAIR, RETURN, OR REPLACEMENT IS NEEDED.

THE LIMITED WARRANTY IS VALID ONLY UNDER THE FOLLOWING CIRCUMSTANCES:

  • The Limited Warranty runs from the original delivery date of the repaired or replaced mattress.
  • You must be the original purchaser from the HIBERIS website or an authorized dealer in the United States.
  • The Limited Warranty is valid only with the original buyer of the product listed on the original invoice or purchase receipt to use the product for personal consumer use, not with the intent to resell the product.
  • In issuing a return or replacement of the mattress, the buyer must present the original invoice or purchase receipt to determine the purchase date, price, and original model name. Your name must appear as the original purchaser.
  • The law tag must remain attached to your mattress to validate this warranty. These tags identify your mattress.
  • The replacement will be another mattress of the same model and size as the initially purchased mattress. Except in the case of the discontinued mattress, the manufacturer will select a current mattress model and size of comparable quality and value. 
  • If identical materials are not available for repair or replacement, the manufacturer reserves the right to substitute materials of comparable quality. The replacement will be another mattress of the same quality and size as the previously purchased mattress.
  • Any implied warranties on this product shall not exceed in duration the term of this Limited Warranty. 
  • The Manufacturer reserves the right to either repair or replaces the mattress if proven to be caused by regular use, manufacturing defects, or faulty crafts.
  • This Limited Warranty will not be renewed or extended if your mattress is repaired or replaced.
  • The buyer shall bear all the transportation costs and inspection fees if needed.

If defects in craft or material are found, the mattress will be repaired or replaced based on the limited warranty term. Buyer shall provide transportation or accept freight charges to and from the HIBERIS SLEEP Corp to either return the product for repair or replacement. In either case, the buyer must provide the original invoice or purchase receipt within the warranty duration.

However, if a warranty defect is not caused by abuse or damage, the mattress will be covered under the standard warranty.

A current, similar quality and value model will be selected if the HIBERIS™ mattress is discontinued at repair or replacement. If identical materials are not available for repair or replacement, the manufacturer reserves the right to substitute materials of comparable quality. All implied warranties on this product shall not exceed the term of this Limited Warranty. 

The Limited Warranty will not be renewed or extended if your mattress is repaired or replaced. 


THIS LIMITED WARRANTY COVERS THE FOLLOWING ITEMS DURING NORMAL WEAR:

  • This Limited Warranty covers any physical flaw in the memory foam or polyurethane foam that causes it to split or crack in the cell structure under normal usage conditions and proper handling.
  • This Limited Warranty covers any deterioration that may cause the mattress to have a visible indentation greater than 1.5” ( one inch and a half) that is not associated with an indentation or sag resulting from the use of an improper or unsupportive bed frame, box springs, foundations, adjustable base, or flat platform. 
  • A strong enough foundation base shall continuously support the mattress to support the weight of the mattress for the warranty to apply.
  • The indentation must be visible to the naked eye when no weight is applied to the top of the mattress. We reserve the right to require the buyer to provide proof of the quality of the foundation, box spring, or base used.
  • A proper bed frame must provide sturdy support for the mattress and foundation, include center support, and have at least six (6) legs for Queen, King, and Cal king and four (4) legs for Twin and Full mattresses. 
  • Failure to have a proper foundation, bed frame, box spring, flat platform, or adjustable base to support the weight of the mattress and its user may invalidate the Limited Warranty. 
  • The outer mattress fabric cover is warranted for one (1) year.
  • Any manufacturing defect in the mattress cover, such as fabric tearing or stitching unraveling and cosmetic damage, affects the mattress's performance. 
  • HIBERIS SLEEP Corp reserves the right to refuse service and invalidate this Limited Warranty upon inspection if the product, mattress, and foundation, are found to be in an unsanitary condition or when product failure is due to causes other than defective material or workmanship. 

THIS LIMITED WARRANTY DOES NOT COVER UNDER CONDITIONS LISTED BELOW:

  • Comfort preference.
  • A regular change/increase in softness of the pressure-relieving material associated with latex foam, memory foam, or polyurethane foam over time does not affect the pressure-relieving qualities of the mattress.
  • If your mattress has any handles attached to it, it’s not covered. The mattress handles are only for positioning the mattress or box spring and are not designed to support the total weight of the mattress.
  • Bed height.
  • Bed height.
  • The mattress is without a law tag.
  • Corner guards.
  • Damage on the mattress or foundation due to misuse or abuse.
  • Mattresses are not appropriately rotated, as required.
  • Body impressions in the mattress (not associated with a sag in foundation) of less than 1 ½" (one and a half inches) which must be visible to the naked eye when no weight is applied to the top of the mattress; If it is determined that an indentation is caused by misuse, abuse, or factors other than a product defect, this Limited Warranty will not cover that condition.
  • Change in firmness preference of the product.
  • Zippered mattress cover damage due to improper care, flaws of the zipper or seams, and tearing of the fabric, including removing the cover.
  • Bedding for hotels, motels, or institutional facilities. 
  • Bedding sold “as is,” floor samples, or bedding purchased from secondhand parties, non-retail establishments, or received as a promotional item.
  • Specific bed sheet fit. The HIBERIS™ mattress does not guarantee that the mattress will fit all particular bed sheet sizes.
  • When an incorrect bed frame is used, mattress damage is caused by abuse or damage due to an inappropriate foundation.
  • Physical abuse or damage to the mattress or box spring structure or mattress fabric cover material, including but not limited to burns, cuts, tears, stains, spots, splotchy, smudgy, foxy, soiling, fluid penetration, scratch, or liquid damage.
  • Matching mattress fabric covers with the box spring fabric covers.
  • Any damage caused to the mattress is associated with using an inappropriate or incorrect bed frame, box springs, foundation, adjustable base, or flat platform that is not designed or constructed to support the weight of the mattress and its user. The mattress must be supported by box springs, foundation, adjustable base, flat platform, or a bed frame with center support and must have at least six (6) legs for Queen, King, and Cal-king, and four (4) legs for Twin and Full mattresses. 
  • Mattress with Law Tag violated, removed, etc..
  • Any damage caused by misuse, neglect, or improper environmental conditions.
  • All items that have been laundered and those mattresses without law tag.
  • Any specially customized products, including custom designs, sizes, shapes, or colors, are non-refundable; this includes, but is not limited to, mattresses, sheets, blankets, pillows, mattress protectors, power/adjustable bases, and other accessories.
  • All transportation, inspection, and removal costs related to the products' repair or replacement.

All products must be returned in appropriate packaging with a copy of the original invoice or purchase receipt. You will be responsible for the new packing cost if you don't have the original.

The Limited Warranty will be invalidated if the product is without a Law Tag attached or with a violation signal.

IMPORTANT INFORMATION 

HIBERIS SLEEP CORP. reserves the right to refuse service and deny or invalidate the Limited Warranty when the product is found in unsanitary conditions upon inspection. May include but is not limited to all items that have been laundered; this included but is not limited to: improper environmental conditions, blood or bodily fluid or other fluids, stains, soiling, unsanitary conditions, torn footprints, spotted, splotchy, smudgy, foxy, fluid penetration, scratch, tears, burns, cuts, rodents, insect damage or other infestation, smoke aroma, odor, signs of jumping on the bed, damage from weather or sun exposure or dirt of unknown origin or nature.

These situations may result in mattress damage that may invalidate your warranty.

The use of cleaning fluids may damage the fabric and materials in your mattress. In addition, allowing water or other liquids to penetrate your mattress may damage the layers of your mattress, causing materials to compress. Either of these situations may result in damage that will invalidate your warranty. 

HIBERIS reserves the right to deny warranty coverage if the mattress set exhibits stains or soiling of unknown origin or other nature that the mattress set may be exposed in an unsanitary condition or may have been damaged by liquid penetration or other abuse. 

HIBERIS gives this warranty, whose name and address appear on the law tag attached to your mattress. Please examine the law tag attached to your HIBERIS™ product and record the name and address of the manufacturer and your warranty code. Then, retain the law tags attached to the mattress and proof of purchase to validate warranty coverage.


D.O.’S and DONT’S of bedding care to protect your mattress and the terms of this WARRANTY:

  • Do use your new Vast mattress on an appropriate firm and flat surface or a frame with center support for your mattress to ensure validation of your limited warranty. 
  • Do replace the old foundation when you purchase a new mattress to provide the proper support for your new mattress.
  • Do use an approved mattress that fits the adjustable bed.
  • Do your mattress upright on its side. It is easier to handle and less likely to damage the mattress. If you need to store your mattress for an extended period, store it flat to prevent damage to the mattress.
  • DO promptly dispose of old mattresses to avoid a fire hazard.
  • Don’t remove the law tag at the end of your mattress, as this has the identification needed to establish your warranty rights.
  • Don’t excessively bend or jump on your mattress under any circumstances. Such treatment may damage the mattress or box spring. 
  • Don’t use cleaning fluids on your mattress; the chemicals may damage some materials. This situation may cause to invalidation of the Limited Warranty.
  • Don’t allow your Vast mattress to get wet. Any liquids, water, or other fluids may damage the upholstery causing materials to compress, and it may cause to invalidate the Limited Warranty.
  • Do Use washable, 100% waterproof mattress protectors. They’ll keep your new mattress in perfect condition for a long time. Plus, your protector will keep out liquids, bedbugs, dust mites, and allergens for clean sleep that makes you feel good.
  • Don’t lift your mattress by the handles (if included). Handles are designed to position the mattress only.

Any damage such as blood or bodily fluid stains, soiling, fluid penetration, unsanitary conditions, torn, spotted, splotchy, smudgy, foxy, odor, liquid penetration, scratch, tears, burns, cuts, smoke aroma, other signs of abuse, and any dirt of unknown origin or nature, may invalidate your Limited Warranty.   

10-YEARS OF NON-PRORATED-COVERAGE PERIOD.
THIS LIMITED WARRANTY IS NOT TRANSFERABLE

FROM YEAR 1(ONE) THROUGH YEAR 10 (TEN) -- NON-PRORATED-COVERAGE PERIOD.

This Limited Warranty is valid only with the original purchaser listed on the original invoice or purchase receipt from HIBERIS™ or an authorized retailer. It extends from the original purchase date of the original product, with the intent to use the product for personal consumer use and not for commercial or industrial use, and not with the intent to resell the product. 

The original purchaser’s name must appear on the invoice or purchase receipt.

The NON-PRORATED Coverage period means that HIBERIS™ will not charge the buyer a percentage of the repair or replacement costs of the product based on the amount of time sleeping on the mattress before noticing a defect.

  • During the ten (10) years of this Limited Warranty, HIBERIS™ will not charge the buyer to repair or replace the mattress so long as it is qualified for repair or replacement under this limited warranty.  
  • In a repair or replacement, HIBERIS™ shall be responsible for the cost of repair or the replaced mattress, excluding all transportation expenses and inspection related to the repaired or replaced mattress. 
  • During the ten (10) years of this limited warranty, all transportation, inspection, and removal costs related to repairing or replacing the repaired or replaced mattress are the purchaser's responsibility.

 HIBERIS SLEEP Corp reserves the right to refuse service, deny, or invalidate this Limited Warranty if the product is found in an unsanitary condition; this may include but is not limited to blood or bodily fluid stains, soiling of unknown origin or nature, or liquid penetration or other abuse than defective material or workmanship. These situations may result in damage that will invalidate your warranty. 

 RIGHTS UNDER STATE LAW

This limited warranty agreement gives you specific legal rights. However, Laws may vary from state to state, although you may also have other rights which vary from state to state depending on each state’s laws.

The duration of any applicable implied warranties shall not exceed the term of this Limited Warranty.

Some states do not allow limitations on how long an implied warranty lasts. So, the above limitation may not apply to you. This Limited Warranty is extended only to the original purchaser from HIBERIS SLEEP Corp. or its authorized retailer.

RIGHTS UNDER STATE LAW

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE, DEPENDING ON EACH STATE’S LAWS. ANY IMPLIED WARRANTIES SHALL NOT EXCEED IN DURATION THE TERM OF THIS LIMITED WARRANTY. THIS LIMITED WARRANTY IS GIVEN ONLY TO THE ORIGINAL PURCHASER FROM HIBERIS CORP. OR ITS AUTHORIZED DEALERS. NO WARRANTIES EXPRESSED OR LIMITED WILL EXTEND TO ANY PERSONS WHO PURCHASED THE PRODUCT FROM ANYONE OTHER THAN THE HIBERIS CORP. OR ITS AUTHORIZED DEALERS. ALL WARRANTIES TO SUCH BUYERS, INCLUDING IMPLIED WARRANTIES, ARE EXCLUDED. NO EXPRESSED OR LIMITED WARRANTIES ARE EXTENDED TO ANY PERSONS WHO PURCHASED THE PRODUCT FROM ANYONE OTHER THAN HIBERIS CORP. OR ITS AUTHORIZED DEALERS. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS. SO, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY IS EXTENDED ONLY TO THE ORIGINAL PURCHASER FROM HIBERIS CORP. OR ITS AUTHORIZED DEALERS.

For the health and safety of those who handle the mattress for disposal, HIBERIS™ may refuse to inspect the mattress or assess whether it is covered by the warranty if there is found evidence of an unsanitary condition; this may include but is not limited to the damage, abuse, neglect, blood or bodily fluid stains, soiling of unknown origin or nature, liquid penetration or other abuse. 

MAKING A CLAIM

To make a valid claim under this limited warranty, you must: make a valid claim under this limited warranty; you must: have a warranty ticket supplied when you contact our customer service at support@hiberis.com. You must include a brief narrative describing the defect and how it affects the mattress’s performance. You also must provide valid proof demonstrating the date of purchase and that the claimant is the original purchaser and still possesses the mattress.

  • Provide photographic evidence of the law tag evidencing that the law tag remains on the bed and has not been altered.
  • Provide sufficient photos of the defect if you believe it would help us understand its nature or upon HIBERIS SLEEP Corp’s request.
  • Please send all requested documentation to support@hiberis.com

You are responsible for submitting your claim with sufficient supporting documentation. IN OUR SOLE DISCRETION, HIBERIS™ reserves the right to require more photographs, further information, or descriptions or to send a representative or independent mattress inspector at your cost to physically inspect the mattress before accepting your claim under this Limited Warranty. 

HIBERIS may void your Limited Warranty if you refuse to cooperate with our investigation, provide adequate responses to our requests, or comply with any provision of this Limited Warranty.

GOVERNING LAW

This limited Mattress Warranty will be governed by the Orange County laws, State of Florida.
